Tesla crash in Texas: whose word do we trust, the driver or the car data?

I read the GONOM post about the Tesla crash in Katy, Texas. Very sad: a 76-year-old woman inside her own home died. The driver says a driver-assistance system was on. Tesla says the data shows the driver pressed the accelerator to the floor and the car reached 73 mph.

My question is more general. When there is a dispute like this, the company owns the data and also has the most to lose. Who checks the data? In France we have the same debate about black boxes in cars. Should this data be held by an independent body? What do you think?
